House of Delegates Policy

Part 9 ~ HOUSE OF DELEGATES

Motion #1003:158
Any date or deadline that falls on a Saturday, Sunday or holiday shall be extended to the next business day.

Section 1. COMPOSITION

A.        Motion #99:85
Chapters shall be notified by February 1 of each year of the number of delegates allotted to them for the House of Delegates meeting for the following year.

B.         Motion #0504:40

            The number of Delegates allotted each Chapter shall be determined each year according to the following method:

1.         A Delegate Base Number shall be derived by dividing the total National number of Professional Classification members in the January 1 census by the number 150.

2.         Each Chapter will be allotted a specified number of Professional Classification members assigned to the Chapters at the January 1st census as follows:

            a.         one (1) delegate if the number of Professional Classification members is less than or equal to the Delegate Base Number; or

            b.         two (2) delegates if the number of Professional Classification members is more than the Delegate Base Number and less than or equal to the Delegate Base Number multiplied by two (2); or

            c.         three (3) delegates if the number of Professional Classification members is more than two times the Delegate Base Number and less than or equal to the Delegate Base number multiplied by three (3); or

            d.         four (4) delegates if the number of Professional Classification members is more than three times the Delegate Base Number and less than or equal to the Delegate Base Number multiplied by four (4); or

            e.         five (5) delegates if the number of Professional Classification members is more than the Delegate Base Number multiplied by four (4).

C.        Motion #99:85

Each Chapter shall send their delegates to the National Convention.
1.         Delegates shall register as such for the National Convention.
2.         Any compensation to delegates shall be determined by the Chapter.

D.        10/92
The House of Delegates Operations Committee and staff shall insure that delegates are properly credentialed.

E.         Motion #0504:40
Notice of Delegate Elections shall be mailed by the Chapter to each Chapter member of record at the last known mailing address no less than thirty (30) days prior to the Chapter Meeting.

F.         Motion #93:107
Only properly credentialed delegates will be admitted to the delegate seating area.  All other members may be seated in another available area.

Section 2.        REPORTING

A.        Motion #99:85
The House of Delegates Operations Committee shall create a written summary of the business of that year’s House of Delegates.

B.         Motion #99:85
The summary shall be sent to all members of that year’s House of Delegates and to all Chapter Presidents within 90 days following the meeting.

C.        Motion #99:85
The summary provided by the House of Delegates Operations Committee shall be published in Hands On (it may be edited according to space limitations) along with a note that the complete summary is available to members upon request. 

Section 3.        RECOMMENDATIONS

A.        Motion #97:13 and Motion #0204:13

Recommendations expressing the opinion of the House of Delegates suggesting action be taken by the Board of Directors or other persons may be considered if:

Motion #0204:13

1.Any recommendations to be considered at the National Convention by the House of Delegates shall be sent to the House of Delegates Operations Committee Chair no later than March 15 of that year, and shall state the recommendation and the rationale for said recommendations. Prior to submittal, the recommendation must be discussed at least at a Chapter Board meeting and preferably at a Chapter meeting and then authorized to be submitted by the Chapter by a majority vote of the Chapter or Chapter Board of Directors.

2. Chapters must submit proposals for consideration by March 15th preceding the convention at which they are to be considered, for the HODOC review. This will permit the committee to review the proposals and return them to chapter with comments, suggestions and recommendations on form, approach and content. The HODOC will return the proposals within 2 weeks giving the chapters about 4 weeks to make any changes they deem desirable and return them to the HODOC by the May 1st deadline for recommendations.   If the chapter chooses not to alter their recommendation on the suggests of the HODOC, or fails to make the deadline for said alterations, then the recommendation will be considered to be submitted in its last revised version for consideration by the HOD.

3.         The recommendations will be sent to the Chapter Presidents, Delegates, and Secretaries no less than ninety (90) days prior to the national convention.

4.         The Chapter shall be responsible for making the recommendations available to the Chapter members.

5.         The House of Delegates Operations Committee Chair shall provide the Moderator of the House of Delegates with a set of the recommendations.

6.         Once sent to the Chapters, recommendations shall be voted on by the House of Delegates as presented and shall not be subject to further amendments by the House of Delegates.

Motion #99:85

7.         The House of Delegates Operations Committee Chair shall submit the recommendations approved by the House of Delegates for consideration on the next National Board of Directors agenda.

8.         The House of Delegates Operations Committee Chair shall report to the House of Delegates on the response of the National Board of Directors to the prior House of Delegates recommendations.

Section 4.        BYLAW AMENDMENT RECOMMENDATIONS CONSIDERED BY THE HOUSE OF DELEGATES

A.      Motion #97:11

Any recommended amendments to the Bylaws to be considered at the National Convention by the House of Delegates shall be sent to the National Bylaws Standing Committee Chair and House of Delegates Operations Committee Chair no later than March 1 of that year, and shall state the present Bylaw, the recommended Bylaw and the rationale for said proposal.  Prior to submittal, the recommended amendment must be discussed at the Chapter Board meeting and then authorized for submittal by the Chapter by a majority vote of the Chapter or Chapter Board of Directors.

B.      Motion #97:11

Recommended Bylaw amendments must be presented on the Bylaw Amendment Recommendation Form provided.  The recommended amendments shall be sent to the Chapter Presidents, Secretaries and Delegates no less than ninety (90) days prior to the National Convention.

C.      Motion#99:85

          The Chapter officers shall be responsible for making the Bylaw amendment recommendations available to the Chapter members.

D.      Motion #97:11

The House of Delegates Operations Committee Chair shall provide the Moderator of the House with a set of the amendment recommendations.

E.      Motion #97:11

Once sent to the Chapters, Bylaw amendment recommendations shall be voted on as presented and shall not be subject to further amendments by the House of Delegates.

F.             Motion #99:85

The House of Delegates Operations Committee Chair shall submit the Bylaw Amendment Recommendation(s) approved by the House of Delegates for consideration on the next National Board of Directors agenda.

G.      Motion #99:85

The House of Delegates Operations Committee Chair shall report to the House of Delegates on the response of the National Board of Directors to the prior House of Delegates Bylaw Recommendations.

H.      10/92

The National Board of Directors may submit a Bylaw amendment proposal to be considered by the House of Delegates at any time.

I.        Motion #97:12            Bylaw Amendment Recommendation Form

1.           The form on the following page(s) shall be used for submitting bylaw amendment recommendations to be considered by the House of Delegates.

BYLAW AMENDMENT RECOMMENDATION FORM

Each Bylaw amendment recommendation to be considered at the National Convention by the House of Delegates must be submitted on a separate form and sent to the National Bylaws Chair and the House of Delegates Operations Committee Chair no later than March 1 of that year.  Recommendations to be considered must be discussed at a Chapter meeting prior to submittal.

1.         Present Bylaw: State relevant portion of current Bylaws exactly as it appears, including Article, Section and Paragraph Number.

2.         Recommended Bylaw : State recommended amendment to portion of Bylaws stated above in #1 in the form that it would appear in the Bylaws.  Indicate whether recommended change is to add, delete, substitute or rescind. Underline changed wording if section or paragraph is not entirely new or re-worded.

3.           Rationale: State reason for and effect intended and expected of recommendation.

Section 5.        SCHEDULING

A.        Motion #92:42

The business meeting of the House of Delegates will be scheduled for a minimum of four hours.

Section 6.        AMTA POSITION STATEMENTS

Motion #0803:86

A.                 Statement of Intent: To establish a unified philosophy for position statements, as well as to implement policies leading to approval of proposed position statements by the AMTA House of Delegates.           

B.                 Definition of a Position Statement:  A position statement is AMTA’s position on professional or public policy issues that relate to the mission and goals of the Association.

C.                 Position Statement Criteria

1.                  Must be related to AMTA’s mission and goals

2.                  Must address professional or public policy issues

3.                  Must be in accordance with AMTA’s statement on discrimination

4.                  Must take a position, not state the need for a position

5.                  Must be submitted in a standard format

6.                  Must not be defamatory

7.                  Must not make references to the position statement of an organization or the stated opinion of an individual

8.                  Must not endorse a political candidate or party

9.                  Must not address internal AMTA issues

10.              Must not endorse a specific product or company.

D.                 Qualifications for a position statement to be submitted

1.                  Evaluation and approval by AMTA legal counsel

2.                  Evaluation and approval of factual accuracy.  Accuracy will be established via a bibliography of references, as well as copies of said references.

3.                  Evaluation, approval and inclusion on any impact on previously approved position statements

E.                  Protocols for distribution of proposed position statements

1.         The idea for a position statement can come from anywhere or from anyone, but must be proposed by an AMTA Professional member. They will be required to complete a Position Statement Proposal Form and submit it to one of their chapter’s delegates/copy to Chapter President.  The delegate will then be responsible for submitting the item to the House of Delegates and will be responsible for the presentation of the item.

2.         There will be no set limit of position statement proposals per year; however, they will be prioritized by the House of Delegates Operations Committee. Proposals that are deemed to require little or no discussion will be grouped together and voted on consent. The remaining proposals will be presented based on criteria established by the House of Delegates Operations Committee.

3.         Position Statement Proposal Forms must be submitted to a delegate no later than February 1st.

4.         A work group will be appointed to review position statement proposals

a.                  Motion #0205:138
There will be a minimum of 3 and up to 5 workgroup members and HODOC Chair will serve as defacto member

b.                  Members will be appointed by HODOC Chair and approved by AMTA President

c.                   AMTA President will appoint Chair of work group

d.                  Work group members must have a minimum of 2 years experience, past or present, as a delegate

5.         There will be an established timeline for review, to include review by the work group and AMTA legal counsel.

a.                   Delegates will submit proposal to Chair of work group

b.                  Work group will submit to Liaison of HODOC

c.                   Staff Liaison will submit to legal counsel

6.         Proposed position statements will be posted on the AMTA Web site for member review and comment.

7.         Proposed position statements will be mailed to the delegates no later than 90 days in advance of their meeting.

F.         Protocols for position statement approval process

1.         The Position Statement agenda is prioritized and set by the House of Delegates Operations Committee and approved by the House of Delegates.

2.         Proposed position statements will be debated and voted upon by the House of Delegates.

            a. Approval requires a 2/3 weighted majority vote by the House of Delegates.

            b. Position statements are not amendable.

            c. Once approved by the House of Delegates, position statements become official documents of AMTA and will be made available for distribution (i.e. may be posted on the AMTA Web site)

3.         Position statements that do not pass the House process will be sent back to the submitter and can be resubmitted the following year.

4.         Position statements will be reviewed every three years, from the date approved, by a current work group. If there is a need to review a position statement sooner, a letter requesting an immediate review may be submitted to the House of Delegates Operations Committee or the AMTA National Board of Directors for consideration.

a.         If a position statement is no longer found to be tenable, the House of Delegates Operations Committee or AMTA National Board of Directors has the authority to rescind the position statement.
